Canada’s ban on polygamy invites the state into the bedrooms of consenting adults, says a B.C. civil rights group that is siding with a controversial religious sect in a landmark court case on the federal law barring multiple marriage. While it, too, is concerned about allegations of child abuse and sexual interference, it argues the government should stay out of the bedroom — but investigate and prosecute criminal activity.

In a decision that could have major implications for a long-running court battle between the state of Utah and the polygamous FLDS sect, a federal judge ruled Thursday that a state takeover of the sect’s property trust six years ago was unconstitutional. Utah’s state courts seized control of the trust in 2005 amid allegations of mismanagement by church leaders, including Warren Jeffs, the newly reinstated head of the church who is currently in jail in Texas pending trial on charges of bigamy, aggravated sexual assault and assault.

Polygamous cult leader Warren S. Jeffs has retaken his post as president of the Fundamentalist Church of Jesus Christ of Latter-Day Saints, according to documents filed with the Utah Department of Commerce. Sources say that Jeffs has also kicked dozens of prominent men out of the FLDS church.

Polygamist sect leader Warren Jeffs won’t stand trial in Texas until at least July after hiring a new lawyer, who argued Monday that the “awesome” amount of evidence in the criminal case is too voluminous to prepare a defense anytime soon. A judge agreed and postponed Jeffs’ trial on charges of having sex with two children at the Yearning for Zion ranch for a second time.
