CALGARY – The case of Jehovah’s Witness teen who died last month, will not be heard in family court.
Judge Alberta Vickery told the court she doesn’t have the jurisdiction to hear the matter.
The lawyers for Bethany and her mother Arliss say their Charter rights were violated last winter. That’s when the 16-year-old was made a temporary ward of the province so blood transfusions could be administered for her leukemia.
Hughes was opposed to the treatment because of her religious beliefs.
“Oh I’m discouraged. I would have certainly liked Judge Vickery to say.’Yes Mr. Gnam, let’s go ahead,” says the family’s lawyer, David Gnam
“But we didn’t hear that today,” he says.
Gnam says there is one more legal avenue. still but he’s not sure if they’ll pursue it because of the cost.
