York’s lawyers want case dismissed
Lawyers for Nuwaubian Nation leader Malachi York have asked a judge to dismiss his federal child molestation case.
Attorney Adrian Patrick on Tuesday argued to dismiss based on two grounds _ that publicity surrounding Yorks earlier guilty plea would violate his right to a fair trial, and that the grand jury was picked from the Middle District of Georgia, which was determined to be a tainted jury pool due to U.S. District Court Judge Ashley Royals change of venue ruling.
The trial is set to begin Jan. 5 in Brunswick.
York is accused of taking children across state lines for the purpose of having sex with them and attempting to evade federal financial reporting requirements.
In January, York pleaded guilty to the federal charges, but Royal determined in October that York withdrew his guilty plea.
