Judge denies motion to suppress confession

BROWNSVILLE, Texas – A judge on Wednesday rejected a motion to exclude a confession by John Allen Rubio, 22, who with his common-law wife is accused of capital murder in the deaths of their three young children in March.

The ruling by state District Judge Robert Garza came on the third day of testimony following the judge’s decision on Friday to oust reporters from the courtroom. He barred the media after Rubio’s attorney, Nat Perez Jr., argued that some evidence presented during the hearing would prejudice Rubio’s right to a fair trial.

Garza said through court coordinator Minnie Torres that all the motions heard Wednesday were denied.

The judge also imposed a gag order forbidding everyone involved in the trial from talking to the media.

Rubio and Angela Camacho, 23, a Matamoros, Mexico, native living illegally in the United States, are alleged to have stabbed, smothered and decapitated the children in their dilapidated Brownsville apartment on March 10 or 11.

On March 11, an acquaintance found the bludgeoned bodies of Julissa Quezada, 3; John Esthefan Rubio, 1; and Mary Jane Rubio, 2 months, then flagged down a police officer for help. Camacho was the mother of all three children, and Rubio was the father of two of the children.

Police say that on the day the couple’s arrest, each confessed on tape and in writing to the killings. The two have pleaded not guilty.

They are being tried in separate courts, and the Cameron County district attorney’s office is seeking the death penalty in both cases.

Rubio’s trial will begin Sept. 22. Camacho’s trial date has not been set because she has not yet been found competent to stand trial. Court-appointed attorney Ernesto Gamez said Camacho was not mentally competent to confess.

The courtroom was dark on Wednesday as videos connected to the case were shown, The Brownsville Herald reported in its Thursday editions.
