Einhorn Looks to Prevent Retrial

PHILADELPHIA- Former hippie guru and one-time fugitive Ira Einhorn is arguing that the new murder trial that was arranged to secure his return to the United States from France would be unconstitutional.
In court papers filed Monday, his attorneys said a Pennsylvania law passed specifically to allow for Einhorn’s retrial violates his protection against double jeopardy, or being tried twice for the same crime.
Jury selection is set for Sept. 24.
Prosecutor Joel Rosen called the defense’s 10 legal motions “just a hodgepodge of a million different things with no legal basis.”
The state Supreme Court in November refused to review the constitutionality of a second trial.
Einhorn, 61, jumped bail and fled the United States in 1981 just before he was to go on trial in the slaying of his girlfriend Holly Maddux, whose mummified remains were found in a steamer trunk in the couple’s Philadelphia apartment.
