Mungiki leader’s plea rejected
A court yesterday dismissed an application by a leader of the outlawed Mungiki sect, Mr Joseph Maina Kamunya, for bail pending hearing of the main case.
Judges Joseph Nyamu and Roselyne Wendoh instead directed that hearing of the main petition lodged by Mr Kamunya at the Constitutional Court be fast-tracked.
Criminal cases
The judges ordered the case be heard on April 26.
The court said it reached the decision to prevent making findings that could prejudice fair hearing of the petition.
“This should be in the interest of consistency and justice,” the judges said.
Mr Kamunya, who is facing two cases at a lower court, moved to the High Court seeking release on bail.
The lower court denied him bail saying he was likely to abscond owing to his past record.
Narcotic drugs
Mr Kamunya was last year charged before a magistrate’s court with being illegally in possession of a firearm and trafficking in narcotic drugs.
In another case, he is charged with consenting to the administering of an unlawful oath.
