Prosecution rests in Emeka King case
The prosecution yesterday closed its case in the ongoing murder and attempted murder charge preferred against the founder and General Overseer of the Christian Praying Assembly, Mr. Emeka Ezeugo, known by his adherents as Rev. King and informed the court that it has proved its case beyond reasonable doubt to convict the accused person on charges against him.
The prosecution team led by Mrs M. A. Asuma, told the court that already they have presented 12 prosecution witnesses to establish their case against the accused person.
However, when the presiding Judge called on the defence counsel, Mr Mike Okoye to open his defence, he informed the court that he had filed a motion on Notice dated October 17, 2006 praying the court for an order “quashing, setting aside and striking out this information/ charges and trial of the accused/applicant before this court”.
He brought his motion on two ground that the information and the trial against his client is in total breach of Section 36 (6) of the 1999 constitution.
Also he claimed that the information and trial is an abuse of the court processes. To this end he urged the court to quash the case in its entirety.
However, the trial Judge, Justice Joseph Oyewole told him immediately that the matter has left that stage because evidence has been led and established by the prosecution.
According to him, the application could only be relevant before the prosecution had closed its case and that there are limited steps the defence could take in the matter now.
Okoye however argued that he decided to bring the application now to establish a no- case submission before the court.
Justice Oyewole adjourned the matter till Friday 27, October, 2006 for him to address the court on the competence of his motion.
