German couple in bid to adopt Deya baby
A German couple has moved to court seeking to be made the guardians of one of Gilbert Deya’s “miracle babies“.
The baby is a subject in a criminal case which has not been concluded.
Questions are likely to be raised as to how the child left Government custody before the conclusion of the case.
The couple, living in Nairobi, claims that the child was committed to Nest Children’s Home on November 9, 2004 and was handed over to them on medical grounds.
But the State challenged the application, saying the children’s home had no mandate to declare any child under its care as abandoned and free for guardianship or adoption.
The couple claims that the baby was given to them due to her medical condition.
This was allegedly done because the man is a diplomatic medical doctor and would take care of the baby.
A woman who swore an affidavit on the doctor’s behalf said: “We took in the child since she needed special care and protection owing to her condition.”
But an officer attached to the Department of Children Services says in an affidavit that the child cannot be declared abandoned since investigations into her parentage have not been completed.
